MANILA, Philippines - The Court of Appeals (CA) Special 7th Division deferred on Wednesday its scheduled hearing of the abduction case of missing activist Jonas Joseph Burgos.
This was because the CA's former Special 7th Division now needs one more member following the promotion to the Supreme Court (SC) of CA Associate Justice Bienvenido Reyes.
Reyes was appointed as SC Associate Justice by President Benigno S. Aquino III last Friday.
According to CA Associate Justice Remedios Salazar-Fernando, one of the members of the Special 7th Division, the SC will be the one to designate the replacement of Reyes in the division.
It was learned that Chief Justice Renato Corona has already chosen a justice to complete the CA Special 7th Division. However, a resolution of the SC still has to be issued on the matter.
Reyes was the former chairman of the CA Special 7th Division. Its members are Associate Justices Fernando and Rosalinda Vicente.
Meantime, Atty. Boyet Fernandez, the legal counsel of the Burgos family, said they were supposed to present in today's hearing their witness from the Commission on Human Rights (CHR) who conducted the investigation on the abduction of Burgos on April 28, 2007 at the ground floor of Ever Gotesco Mall in Commonwealth Avenue, Quezon City.
The next hearing of the Burgos case is set on August 31, 2011.
