MANILA, Philippines - (UPDATED 4:34 PM) The disbarment complaint against Acting Chief Justice Antonio Carpio has been dismissed, removing any barrier to his possible inclusion in the shortlist of nominees for the top judicial post, even as the Judicial and Bar Council (JBC) deferred to Monday its release of the shortlist for submission to the President.
The council failed to resolve the matter of whether or not to include in the shortlist three candidates with pending case.
There was a proposal to suspend the rules disqualifying a candidate with a pending case--whether criminal, civil or administrative--Iloilo Representative Niel Tupas Jr. said in an ambush interview.
Candidates with pending cases are Justice Secretary Leila De Lima, SEC Chair Teresita Herbosa and Solicitor General Francis Jardeleza.
The JBC was is expected to release the shortlist this (Friday) afternoon, after being derailed by the rains and floods of recent days. From that list, President Benigno Aquino III is to pick the successor of Renato C. Corona, who was ousted by the Senate impeachment court last May after a historic trial that lasted over four months.
