DOLE reminds employers to follow Eid’l Fitr pay rules

MANILA, Philippines – “Pay your workers correctly and observe applicable pay rules.”

This is Department of Labor and Employment (DOLE) Secretary Silvestre Bello III’s reminder to employers as the country celebrates Eid’l Fitr on Monday, June 26, marking the end of Ramadan.

“As the Filipino nation unites with the Muslim community in celebration of the Feast of Ramadhan, we are reminding employers to comply with general labor standards, particularly with the proper payment of wages,” Bello said in a statement issued Friday, June 23.

Malacañang earlier declared June 26 a regular holiday throughout the country to give Filipinos the opportunity to join their Muslim brothers and sisters “in peace and harmony in the observance and celebration of Eid’l Fitr.”

Eid’l Fitr is celebrated by the Muslim world for three days after the end of the month of fasting.

Pursuant to Proclamation No. 235 issued by President Rodrigo Duterte, the DOLE chief issued Labor Advisory No. 8, Series of 2017 prescribing the following pay rules for Monday:

–If the employee did not work, he/she shall be paid 100% of his/her salary for that day [(Daily rate + COLA)] x 100%]

–For work done during the regular holiday, he/she shall be paid 200% of his/her regular salary for that day for the first eight hours [(Daily rate + COLA) x 200%]

–For work done in excess of eight hours (overtime work), he/she shall be paid an additional 30% of his/her hourly rate on said day (Hourly rate of the basic daily wage x 200% x 130% x number of hours worked)

–For work done during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her daily rate of 200% [(Daily rate + COLA) x 200%] + [30% (Daily rate x 200%)]

–For work done in excess of eight hours (overtime work) during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her hourly rate on said day (Hourly rate of the basic daily wage x 200% x 130% x 130% number of hours worked)

Meanwhile, in observance of Eid’l Fitr, the United States Embassy in Manila will be closed on June 26, Monday, an advisory from the consulate said.

The embassy and its affiliated offices will resume their services on June 27, Tuesday.
